1. What this is
Black Swan Stats ("the service", "we") is a website that presents NFL statistics and context: schedules, rosters, depth charts, injury reports, player and team game data, coaching tendencies, weather, and links to news coverage. These terms are an agreement between you and Lansdowne Data, the operator of the service. By creating an account or using the service you accept them.
2. Data and context only
The service provides information. It does not provide advice of any kind, and nothing on it is a recommendation to make, or refrain from making, any wager, purchase or decision. We do not offer picks, predictions, tips, or ratings of any outcome. Statistics and third-party reporting can be late, incomplete or wrong, and you use them at your own judgement. We are not affiliated with the National Football League or any of its teams.
3. Accounts
You need an account to use most of the service. Keep your password private; you are responsible for activity under your account. You must give a working email address, and you must be old enough to form a binding contract where you live. One person per account; do not share or resell access.
4. Subscriptions, trials and billing
Paid access is a recurring subscription billed by Stripe on our behalf at the price shown when you subscribe. A free trial, when offered, converts to a paid subscription at its end unless you cancel first. You can cancel at any time from your account page; access continues to the end of the period already paid for, and we do not refund partial periods except where the law requires it. We may change prices with at least thirty days' notice by email; the new price applies from your next renewal. Promo codes carry their own conditions and cannot be exchanged for cash.
5. Acceptable use
You may use the service for your own personal, non-commercial reading. You may not copy, scrape, crawl, download in bulk, redistribute, resell or republish its data or pages, frame or mirror it, use it to build a competing dataset or product, probe or overload it, or circumvent access controls. We may suspend or close accounts that do.
6. Sources and intellectual property
Statistics, schedules, rosters and official injury reports come from the nflverse project under the Creative Commons Attribution 4.0 licence; weather comes from the United States National Weather Service. News headlines belong to their publishers, are linked to them and quoted briefly. Team names appear only to identify teams. The design, text, organisation and code of the service are ours. You get a limited, revocable licence to view the service; no other rights are granted.
7. Availability and changes
We can change, suspend or discontinue any part of the service at any time. We aim for the service to be available and current during the season but do not promise it, and scheduled data may arrive later than expected.
8. Disclaimer and limitation of liability
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and non-infringement. To the fullest extent the law allows, we are not liable for any indirect, incidental, consequential or special damages, or for any loss arising from reliance on the service, and our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim.
9. Termination
You can close your account at any time by contacting us. We can suspend or terminate accounts that breach these terms. Sections 2, 6, 8 and 10 survive termination.
10. Governing law
These terms are governed by the laws of [State], United States, without regard to conflict-of-law rules, and disputes will be brought in the courts located there.
11. Changes to these terms
We may update these terms. Material changes are announced by email or on the site before they take effect; continuing to use the service after that is acceptance.

What we collect
Account data. Your email address and a hashed password, when you accepted the terms, and any preferences you set (such as a display timezone).
Billing data. Payments are handled by Stripe. We do not see or store your card number. We keep Stripe's identifiers for your customer and subscription, your plan, and the state of your subscription.
Usage and technical data. Server logs with your IP address, browser type, the pages requested and timestamps, kept for security and debugging. Error reports may include the page you were on and your account id. Site analytics, when enabled, are aggregate and cookieless.
Cookies and local storage. A session cookie keeps you signed in and a CSRF cookie protects forms. Your colour-theme choice is stored in your browser's local storage. We set no advertising or tracking cookies.
How we use it
To run your account and subscription, to send you service emails (verification, password reset, billing notices), to keep the service secure and working, and to understand how it is used in aggregate. We do not sell personal data and we do not use it for advertising.
Who else sees it
Providers that run the service on our behalf, each under their own terms: Heroku (hosting and database), Stripe (payments), Cloudflare (network and security), Sentry (error reports) and our email delivery provider. We disclose data when the law requires it.
How long we keep it
Account data for as long as your account exists, then deleted within thirty days of a closure request. Billing records for as long as tax and accounting rules require. Server logs for up to ninety days.
Your rights
You can see and change your email and password from your account page. To get a copy of your data, correct it, or delete your account, email us; we answer within thirty days. Depending on where you live you may have further rights under laws such as the GDPR, the UK GDPR or the California Consumer Privacy Act, and you can exercise them the same way.
Children
The service is not directed to children under sixteen and we do not knowingly collect their data.
Changes
We may update this policy. Material changes are announced by email or on the site before they take effect.
